本使用條款（以下稱「本條款」）為你與 CT Wu（個人開發者，以下稱「開發者」、「我們」）之間，關於使用 Gemr（以下稱「本 App」）的合約。下載、安裝或使用本 App，即表示你同意本條款。
我們授予你一項有限、非專屬、不可轉讓的授權，讓你在你所擁有或控制、且符合 Apple《App Store 服務條款》所允許之使用規則的 Apple 品牌裝置上使用本 App。你不得複製、散布、出租、出售、逆向工程或製作本 App 的衍生作品，法律明文允許者除外。
本 App 提供資訊性研究、市場資料整理與 AI 輔助分析，僅供參考，不構成投資建議、招攬、要約，亦非券商、投資顧問或財務顧問服務。本 App 不保證任何資料的正確性、完整性或即時性；市場資料可能為延遲資訊，且可能包含來源或模型產生的錯誤。所有投資決策由你自行判斷並自負風險。過往表現不代表未來績效。
本 App 的維護與支援由開發者單獨負責。Apple 對本 App 不負任何維護或支援義務。支援請聯絡 ctwu95@gmail.com。
在適用法律允許的最大範圍內，本 App 依「現狀」與「現有」基礎提供，不附任何明示或默示的保證。若本 App 未能符合任何適用的保固，你可通知 Apple，Apple 將依適用規定退還你的購買價金（如有）；除此之外，在法律允許的最大範圍內，Apple 對本 App 不負任何其他保固義務。
就本 App 相關之任何索賠，包括但不限於：(a) 產品責任；(b) 本 App 未能符合任何適用法律或法規要求；(c) 消費者保護、隱私或類似法規所生之索賠，均由開發者（而非 Apple）負責處理。
本 App 及其內容之所有權與智慧財產權屬於開發者或其授權人所有。若有第三方主張本 App 或你對本 App 的持有與使用侵害其智慧財產權，由開發者（而非 Apple）負責該索賠之調查、辯護、和解與清償。
你聲明並保證：(a) 你並非位於受美國政府禁運或被指定為「支持恐怖主義」之國家；(b) 你未被列於任何美國政府之禁止或限制名單中。你亦同意於使用本 App 時遵守所有適用之當地法律。
Apple 及其子公司為本條款之第三方受益人。當你接受本條款時，Apple 有權（且視為已接受該權利）以第三方受益人之身分對你執行本條款。
在適用法律允許的最大範圍內，開發者對因使用或無法使用本 App 而生之任何間接、附帶、衍生或懲罰性損害不負責任。
我們可能不時更新本條款，並於本頁面公告修訂版本與新的生效日期。變更後繼續使用本 App，即視為你接受修訂後之條款。
本條款依中華民國（臺灣）法律解釋與適用，並排除其法律衝突原則之適用。

These Terms of Use (the "Terms") form an agreement between you and CT Wu, an individual developer (the "Developer," "we," "us"), governing your use of Gemr (the "App"). By downloading, installing, or using the App, you agree to these Terms.
We grant you a limited, non-exclusive, non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, distribute, rent, sell, reverse-engineer, or create derivative works of the App except as expressly permitted by law.
The App provides informational research, market-data organization, and AI-assisted analysis for reference only. It does not constitute investment advice, solicitation, or an offer, and is not a brokerage, investment-adviser, or financial-adviser service. The App does not guarantee the accuracy, completeness, or timeliness of any data; market data may be delayed and may contain source- or model-generated errors. All investment decisions are your own and made at your own risk. Past performance does not indicate future results.
The Developer is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support with respect to the App. For support, contact ctwu95@gmail.com.
To the maximum extent permitted by applicable law, the App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App.
The Developer, not Apple, is responsible for addressing any claims relating to the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
All title and intellectual property rights in and to the App and its content belong to the Developer or its licensors. In the event of a third-party claim that the App or your possession and use of it infringes intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with all applicable local laws when using the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
To the maximum extent permitted by applicable law, the Developer will not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of, or inability to use, the App.
We may update these Terms from time to time and will post the revised version with a new effective date on this page. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by and construed under the laws of the Republic of China (Taiwan), excluding its conflict-of-law principles.
